Scrutinize Wasteful Corporate Tax Breaks Before Cutting Vital Services

Statement by California Labor Federation Executive Secretary-Treasurer Art Pulaski on May Revise of the State Budget

“For every cut the state is asking seniors, those with disabilities, workers and low-income Californians to absorb in the May Revise, there’s a wasteful corporate tax break that’s draining much-needed revenue. The cuts proposed today aren’t borne of necessity; they’re the result of a failed system that protects tax giveaways for the wealthy and well-connected at the expense of California’s most vulnerable. That’s inexcusable.

“It’s clear that budget stability can’t be achieved without additional revenue. Voters must approve Gov. Brown’s revenue initiative this fall to stave off even more devastating cuts to schools and public safety. But to create long-term stability, the state has to eliminate the maze of loopholes, carve-outs and tax-dodges that corporate lobbyists have written into law over the years, many through backroom deals as leverage in previous budget negotiations.

“Tax giveaways create incentives for big corporations to ship jobs out of state and reward companies for eliminating good-paying jobs and replacing them with low-income, no benefit jobs. These wasteful tax breaks put small businesses at a competitive disadvantage to big corporations. It defies common sense that California continues to offer devastating cuts to vital programs without first getting rid of wasteful tax breaks that cost the state billions every single year.

“We call for an immediate review of every corporate tax break that’s currently lacking a sunset provision before a single cut to essential services is made. If these tax breaks aren’t doing what they intended, they should be abolished and those funds should instead go to restoring programs California families rely upon.

“It’s high time that our system reflects the interests of middle-class Californians, not the special interests of corporate CEOs and their lobbyists.”

California Labor Announces Local Endorsements for June Primary

This week, as absentee voters across California began receiving their primary election ballots in the mail, the California Labor Federation officially released its complete list of endorsements by county for local, state and federal races and ballot measures on the June primary ballot.

“In a time of unprecedented challenges facing working people, this year’s elections are pivotal to the direction of our state,” said California Labor Federation Executive Secretary-Treasurer Art Pulaski. “Labor’s grassroots program is more critical than ever to counterbalance the unlimited political spending and power of well-heeled corporate interests.”
Thursday: Day of Action to Support NorCal Grocery Workers

After eight months of difficult negotiations, big chain grocers in northern California -- including Raley’s, Nob Hill, Safeway and Savemart -- are still pushing for deep cuts in benefits for both workers and retirees. Now the workers are fighting back, and they need your support.

On Thursday, May 17th, show your support for the grocery workers and their union, UFCW 5, by joining the massive day of action. Demonstrations will take place at 30 different grocery store locations across northern California, and transportation will be provided. At the end of the day, participants from all the demonstrations will converge in San Jose for a 4pm rally at Cesar Chavez Park.
Take Action for a Fair Union Election at American Airlines

The National Mediation Board (NMB) set May 17 as the date for a union representation election for over 9,600 ticket, gate and reservation agents at American Airlines. But in a reckless disregard for the rule of law, American Airlines has simply decided to refuse to provide employees’ addresses so the NMB can mail them voting instructions.
Take action to support workers’ rights at American Airlines by sending a message to National Mediation Board General Counsel Mary Johnson, asking her to stand up to American Airlines and ensure the election moves forward.

Workers Memorial Day: Mourn for the Dead, Fight for the Living

More than 300 California workers lost their lives in work-related accidents in 2010, and another 6,500 died from chronic workplace exposure to chemicals and other toxins. Additionally, for every 100 California workers, four nonfatal injuries are disclosed annually to the workers compensation system, and countless more go unreported. It is clear that more needs to be done to keep workers safe and healthy at work.

Tomorrow is Workers Memorial Day, the one day a year dedicated to commemorating the fallen, protecting the injured and preventing future injuries and fatalities. The California Labor Federation and Cal/OSHA are working on a number of new initiatives to minimize the number of workplace accidents, ensure adequate treatment for injured workers and provide support for the families of those who’ve died at work.
Tomorrow: Informational Picket at UC Santa Cruz Alumni Reunion

Skilled Crafts workers at UC Santa Cruz have been fighting for more than six months for a fair contract that would provide them with the same basic benefits and protections as other UCSC employees, but the management is refusing to consider the workers’ proposals.

This weekend, as UCSC alumni celebrate their reunion, the Skilled Crafts employees will be holding an informational picket, in order to raise awareness of the vital work they perform for the UCSC community, and put pressure on the university to grant these workers the same sorts of wages, benefits and respect their fellow UCSC workers already receive. The picket will take place from 9am to noon at the main entrance to the campus.
And the employer has no problem treating the workers themselves like garbage, forcing them to toil in hazardous working conditions for poverty wages, refusing to provide benefits, and firing workers who make any effort to improve their conditions.

On May 1st, International Workers Day, the waste and recycling workers will be joined by hundreds of other workers and supporters to protest American Reclamation’s abhorrent mistreatment of its workers. The action will begin at 11am at American Reclamation (4500 Doran St, LA).
Port Drivers Claim Victory in Historic Union Vote

It’s been a year since a brave group of port drivers decided to form a union to defend themselves from the rampant exploitation, poverty wages and third-world working conditions imposed on them by their employer, Toll Group. Despite enduring a year of harassment, vitriol and retaliatory firings from the billion-dollar company, the workers voted overwhelmingly to join the Teamsters this week.

The victory is being hailed by local and international supply chain workers, labor and community allies as a trailblazing private sector win in an industry notorious for treating workers as disposable. This ground-breaking achievement is inspiring truck drivers across the country that they too can band together to combat exploitation through union representation.

California Supreme Court Decision Erodes Workers’ Right to Meal Breaks

Statement by California Labor Federation Executive Secretary-Treasurer Art Pulaski

“Every worker deserves a meal break on the job. For many workers, the ability to take a break is critical to health and safety. By weakening current law, the California Supreme Court has sided with corporations over the rights of waitresses, health care workers, construction workers, retail workers and others.

“With its unjust decision in the Brinker case today, the Court struck a blow to workers’ fundamental right to take a meal break on the job. The decision unnecessarily muddies the waters on businesses’ responsibility to provide meal breaks, which opens the door for worker exploitation. The Court has left a confusing and vague patchwork of concepts that will encourage employers to continue to circumvent the law. It shouldn’t be so hard to make employers do what is easily within their power to do: make sure workers get their meal breaks.

“While the Court let workers down today, this fight is far from over. The California labor movement is committed to ensuring that every worker has the right to a meal break. “

Convention kicks off massive grassroots mobilization for this year’s elections

The California Labor Federation, representing 2.1 million union workers across the state, today announced endorsements in State Assembly, Senate and congressional races, as well as ballot measures, for the June primary election at California Labor’s Pre-Primary Convention in Los Angeles.

The convention kicked off California Labor’s grassroots election campaign, which relies heavily on volunteers mobilizing to reach voters by phone, through the mail, online and in-person about the importance of the upcoming elections to all workers.

“In a time of unprecedented challenges facing working people, this year’s elections are pivotal to the direction of our state,” said California Labor Federation Executive Secretary-Treasurer Art Pulaski. “The core of our election program is the dedication and commitment of thousands of volunteers reaching millions of voters with vital information about candidates’ positions and measures impacting workers. In an era of Citizens United, labor’s grassroots program is more critical than ever to counterbalance the unlimited political spending and power of well-heeled corporate interests.”

Endorsements are determined through a democratic process by which delegates to the California Labor Federation representing both public and private sector unions vote to support candidates and ballot measures. Delegates voted today on endorsements for the June primary only. General election endorsements for candidates and ballot measures occur at the Federation’s Biennial Convention in July.

California Labor Federation Sanctions Communications Workers Strike at AT&T West

(Oakland) -- The California Labor Federation, representing more than 1,200 local unions and 2.1 million members, today sanctioned a potential strike by workers at AT&T West represented by the Communications Workers of America (CWA). Contract negotiations between AT&T West and CWA continue today. The workers' current contract expires at 12:01 a.m. Sunday, April 8.

Ninety-three percent of workers represented by CWA at AT&T West voted to authorize a strike if negotiations fail to produce a fair contract. The contract negotiations impact more than 18,000 workers represented by CWA at AT&T West in California, Nevada and Hawaii.

"Middle-class supporting jobs are the backbone of our economy," said California Labor Federation Executive Secretary-Treasurer Art Pulaski. "Large, profitable companies like AT&T have a responsibility to provide a good wage, health care and retirement to their workers. The California labor movement stands in solidarity with workers at AT&T as they continue to fight for a fair contract that provides a decent standard of living for their families."

AT&T is the largest and most profitable company in the communications industry. It’s the 12th biggest company in America. In 2010, AT&T recorded profits of $19.86 billion on revenues of $124 billion. Last year, AT&T made $20 billion in profits.

The unions of the California Labor Federation, through the strike sanction, fully commit to supporting AT&T workers through public actions and on picket lines if a strike is called.

New High-Speed Rail Plan a Blueprint for 21st Century Infrastructure

The California High-Speed Rail Authority this week unveiled its revised business plan, which will make construction and development of California’s the high-speed rail system “better, faster and cheaper.” The new plan would increase ridership by connecting Fresno to the LA basin during the first phase of the project, while at the same time cutting $30 billion from the price tag by using existing commuter rail lines and other cost-saving measures.

“High-speed rail will transform our state’s economy and lead to sustained job growth,” said Executive Secretary-Treasurer Art Pulaski. “The construction of the project will put hundreds of thousands of Californians, who have lost jobs through no fault of their own, back to work. The project promises to be a boon for small business, creating a renaissance for California entrepreneurs.”
Speak Out to Help Restore Benefits to Injured Workers

Governor Schwarzenegger’s 2004 workers’ compensation reforms drastically cut injured worker benefits, delayed medical treatment for many workers, and created unsustainable and unaffordable new costs that threaten the viability of the entire system. But the Brown administration is taking important steps to find out what works – and what doesn’t – for injured workers and other stakeholders in California’s workers comp system.

Beginning April 10th, Department of Industrial Relations Director Christine Baker and Division of Workers Compensation Administrative Director Rosa Moran will conduct several workers’ comp public forums around the state. The Labor Agency’s goal of the listening tour is to learn how the system can best provide decent benefits and adequate medical treatment to workers injured on the job. Don’t miss this unique opportunity to speak out in favor of a workers’ comp system that reflects the needs of California’s workers—not the profiteering interests now cashing in on Schwarzenegger’s mistakes.

High-Speed Rail Plan a Blueprint for 21st Century Infrastructure

Statement by California Labor Federation Executive Secretary-Treasurer Art Pulaski

“With the release of today’s new business plan, Gov. Brown and the High-Speed Rail Authority offer a viable, innovative blueprint to realizing a 21st century California infrastructure.

“The Authority’s plan to connect the Central Valley and Los Angeles basin in the first phase of high-speed rail construction makes perfect sense financially and operationally. By saving tens of billions of dollars through the use of existing commuter rail lines, the Authority’s new plan addresses funding challenges while giving Californians a realistic, transparent roadmap to making the vision of high-speed rail a reality.

“For far too long, the politics of decline have scarred California growth. We can no longer afford to compete with China and other large economies from behind. It’s time to invest in California’s future. High-speed rail will transform our state’s economy and lead to sustained job growth. The construction of the project will put hundreds of thousands of Californians, who have lost jobs through no fault of their own, back to work. The project promises to be a boon for small business, creating a renaissance for California entrepreneurs.

“As with any bold project, the voices of doom and decline say it can’t be done. They said it in the 20th century when California constructed a world-class infrastructure of freeways, dams, bridges and aqueducts that connected our communities and fostered a golden age of middle-class growth. We must reject the voices of decline now, as we did then, to reinvent California.

“We commend Authority Chair Dan Richard, the Authority board and Gov. Brown for providing the leadership our state needs to move forward. We urge the legislature to act boldly and swiftly to release voter-approved bonds that will allow construction to begin on this critical project by early next year.”

Bay Area Workers Protest Romney Fundraiser, Call for Advisor’s Resignation

In the wake of a recent corruption scandal at the National Labor Relations Board involving one of Mitt Romney’s chief campaign advisors, more than 100 workers and activists came out to protest Romney at a ritzy fundraiser at the Sofitel in Redwood City. The protestors called on Romney to fire campaign advisor Peter Schaumber, who wrongfully received confidential information from NLRB board member Terence Flynn, and used that information to public attack the NLRB.

According to California Labor Federation leader Art Pulaski, “This type of unethical behavior may be acceptable in the corporate culture of Bain Capital, but certainly it shouldn’t be tolerated from those involved in a campaign for our nation’s highest office. If Gov. Romney fails to condemn the actions of Mr. Flynn and Mr. Schaumber and take the appropriate action, it’s as good as a seal of approval on the use of unethical practices to advance his campaign.”
Now, Raley’s, Safeway and Save Mart have launched the same sort of assault against more than 50,000 grocery workers in northern California, and this week, hundreds of workers hit the streets in Pleasanton to call for good jobs and affordable health care.

California Labor Federation Calls on Romney to Dismiss Advisor Over NLRB Ethical Violations

Workers to Protest Romney Fundraising Event Tonight in Redwood City

(Oakland) -- As Mitt Romney heads to a high-dollar fundraiser tonight in Redwood City, one of Romney’s key advisors is in the middle of a growing controversy over unethical practices by National Labor Relations Board member Terence Flynn.

The Inspector General issued a report Friday finding that Flynn improperly leaked confidential material on board deliberations. The report details numerous instances of then-chief counsel Flynn funneling confidential information about the labor board’s activities and deliberations, including attorney-client privileged information, to two former NLRB members who have been actively engaged in a relentless campaign to undermine and discredit the NLRB through legal and rhetorical challenges to the agency’s activities. One of those former board members is Romney advisor Peter Schaumber. The report makes clear that Schaumber used the information to publicly attack the NLRB.

“This type of unethical behavior may be acceptable in the corporate culture of Bain Capital, but it certainly shouldn’t be tolerated from those involved in a campaign for our nation’s highest office,” said Art Pulaski, chief officer of the California Labor Federation. “If Gov. Romney fails to condemn the actions of Mr. Flynn and Mr. Schaumber and take the appropriate action, it’s as good as a seal of approval on the use of unethical practices to advance his campaign.”

Romney has been a vocal critic of the NLRB, even going so far as to call for the elimination of the board’s funding.

A group of workers affiliated with the San Mateo Labor Council will protest tonight’s fundraiser at the Hotel Sofitel in Redwood City, highlighting Romney’s anti-worker positions which include calling for a national “Right to Work for Less” law, repealing prevailing wage laws and backing efforts to strip workers of collective bargaining rights.

“Multi-millionaire Mitt doesn’t know the first thing about the struggles working people are facing in this economy, and it shows,” said Shelley Kessler, executive secretary-treasurer of the San Mateo Labor Council. “Workers are the backbone of this country, and they deserve a president who will look out for their interests, not the special interests of the corporate elite that are fully responsible for cratering our economy.”

California Labor Unveils “Invest in California” Jobs Plan for the 99%

This week, the California Labor Federation and State Building and Construction Trades Council released a comprehensive six-point plan to rebuild our economy and put people back to work by investing in infrastructure, manufacturing, clean energy and education, while at the same time addressing the tax fairness and income inequality issues that continually plague our state.

“Yes, California has taken more than its share of hits in this economy, but we can rebuild an economy of broadly shared prosperity the same way our grandparents created it: by investing in infrastructure that gives our businesses a competitive edge,” California Labor Federation’s Art Pulaski said. “We can come roaring back by investing in universities that are incubators of innovation and schools that train workers to make products invented in California right here in California. And when workers, not just CEOs, have good jobs, Californians will be working their way into the middle class, not falling out of it.”
California Labor Launches Jobs Plan for the 99%

“Invest in California” Provides Blueprint for Economic Recovery

Sacramento, CA – Calling on California leaders to renew the state’s commitment to innovation and investments that built an economy of broadly shared prosperity, California’s labor community today launched a plan for job creation and economic recovery called “Invest in California.”

Released today by the California Labor Federation and State Building and Construction Trades Council as hundreds of the organizations’ members convened in Sacramento for their annual Joint Legislative Conference, the six-point plan calls for significant investments in areas that support job growth, while also calling for an end to wasteful state spending on corporate tax breaks that encourage outsourcing of jobs.

California Labor Federation Executive Secretary-Treasurer Art Pulaski said support for investing in California will be a threshold question for candidates and elected officials seeking working families’ support in 2012.

“Yes, California has taken more than its share of hits in this economy, but we can rebuild an economy of broadly shared prosperity the same way our grandparents created it: by investing in infrastructure that gives our businesses a competitive edge,” Pulaski said. “We can come roaring back by investing in universities that are incubators of innovation and schools that train workers to make products invented in California right here in California. And when workers, not just CEOs, have good jobs, Californians will be working their way into the middle class, not falling out of it.”

The six-point “Invest in California” plan includes:

	1) Infrastructure: Invest in repairing and retrofitting the infrastructure that made California great. $9 billion in bonds already sold can be put to work in shovel-ready projects. Public pension fund investment in infrastructure projects and construction of high-speed rail will create jobs and improve California’s competitiveness.

	2) Manufacturing: If we invent big ideas in California, we should manufacture them here. Support businesses that manufacture products they invent here. Speed up businesses’ ability to create jobs without weakening worker protections or environmental standards.

	3) Education: California needs the most educated and skilled workforce in the world to compete in the global economy, but budget cuts have put California school funding behind Mississippi, Alabama, China and Korea. We need to restore $18 billion to K-12, community colleges and higher education, and expand and create new campuses to improve access.

	4) Revenue: Raise revenue to fund education, public safety and other essential services by revamping our tax code so it’s fair. Put special carve-outs for corporations to the jobs test: no new net jobs, no more tax breaks. When corporations ship their jobs overseas, their tax breaks should disappear.

	5) Clean Energy: Create a clean and green revolving loan fund to help manufacturers to meet AB 32 requirements and create good jobs. Retrofit public buildings and schools to capture savings with high standards and union labor.

	6) Ending Income Inequality: Economic recovery starts when workers have enough money in their pockets to buy products made in California. Require companies that receive state contracts, grants, or tax breaks to pay living wages with health benefits, and preserve project labor agreements that build our communities with living wages.

“When it comes to a strong economy and the quality of life we want for families, we’re all in this together, whether or not we carry a union card in our pocket,” said Bob Balgenorth, president of the State Building and Construction Trades Council. “Workers who build our roads, bridges and ports succeed when we invest in our infrastructure, and so do the private sector businesses who transport goods on them. Businesses thrive -- and create more jobs – when teachers and firefighters have dollars to spend. Our state isn’t short on work ethic, we’re just short on work.”

Rejecting the notion that the state’s deficit prevents investment in our future, AFSCME Senior Assistant Director Willie Pelote called for an end to corporate tax giveaways, like enterprise zone credits, that are bleeding the state of billions that could support job creation and spur real economic development.

“To the voices of doom and decline who claim we can’t afford to invest in our future, we say: when 93% of the income gains over the last decade have gone to just 1% of the population, it’s clear the problem isn’t that California is broke, it’s that our system is broken,” said Pelote.

Labor leaders say they will build support for the plan with events in communities around the state, and will seek to enact the elements of the plan through legislative advocacy and at the ballot box.

Pulaski: “We’re going to be posing a simple question to our leaders: will you invest in our future and rebuild our economy, or keep wasting billions on tax breaks for those who need them the least?”

Thursday: Nationwide Day of Action to Protest Corporate Greed at Verizon

When the management at Verizon first refused to bargain a fair contract with its employees in August of last year, 45,000 Verizon workers walked off the job to protest the company’s greedy behavior. Although the company did go back to the negotiating table, many issues still remain unresolved, and no contract is in sight.

On Thursday, take a stand against the culture of corporate greed that allows Verizon to short-change working families, shirk their fair share of taxes and reward executives with multi-million dollar compensation plans by joining the Nationwide Day of Action against Verizon. Hundreds of events will be taking place all around the country, with more than a dozen actions scheduled in cities across California, and all are encouraged to participate.
Pacifica Hires Notorious Union-Busters at KPFA Radio

The Pacifica Foundation, which owns Berkeley-based KPFA-FM Free Speech Radio, has ramped up its aggressive campaign against its workers and their union, CWA 9415, by hiring Jackson Lewis, one of the most notorious union-busting law firms in the nation. The new agreement with Jackson Lewis comes on top of over $100,000 KPFA has already spent on other anti-union legal consultants.

“We see the entry of Jackson Lewis as a declaration of war on the unions that represent Pacifica workers,” the CWA union shop stewards wrote in a letter to the management. “We fear it will lead to unnecessary legal expenses the network can ill afford, sour Pacifica’s already dismal relationship with its union workers, and alienate many listener-supporters who do not want their donations to be handed over to one of organized labor’s greatest enemies in the United States.”

This week, more than 400 labor leaders, workforce partners and community activists converged in LA at the 2012 ‘Building Workforce Partnerships’ conference (BWP), sponsored by the California Labor Federation’s Workforce and Economic Development program.

BWP has gained national recognition as the largest workforce conference of its kind, where high road labor-management training partnerships are highlighted and workforce development, labor, academic, and community allies can come together to talk about workforce and economic development from a progressive perspective. This year’s conference featured cutting-edge workshops, a joint plenary session with the BlueGreen Alliance, and a keynote speech from Jared Bernstein, former senior advisor to Vice President Joe Biden.
Register for the 2012 Workers’ Comp Navigators Workshop

Injured workers continue to face major problems due to California’s difficult-to-navigate workers’ comp system. Many don’t receive adequate medical care or other benefits, and some are threatened with job loss.

The California Labor Federation is partnering with the UC Berkeley Labor Occupational Health Program to present a one-day workshop focused on training and strategic planning to help injured workers navigate California’s workers’ comp system. The program will cover all major aspects of the California workers’ compensation system, and will also highlight community resources and strategies for protecting workers’ rights. The workshop will take place on April 19th from 8:30am to 5pm at the Elihu M. Harris State Building (1515 Clay Street in Oakland).
